Breaking: Oregon Federal Judge Limits ICE Warrantless Arrests

On February 4th 2026, a federal judge in Oregon has ruled that U.S. Immigration and Customs Enforcement (ICE) can no longer make routine warrantless civil immigration arrests in the state unless there’s a clear risk the person might flee before a warrant can be obtained. The preliminary injunction came from U.S. District Judge Mustafa T. Kasubhai following a class-action lawsuit challenging “arrest first, justify later” practices.

The decision emphasizes due process and constitutional protections, requiring federal immigration agents to secure warrants from a judge or magistrate in most cases. It will remain in effect as the case continues to be litigated.

This ruling marks an important moment in how immigration enforcement is conducted in Oregon and could influence similar legal challenges in other states.
